Two Lancaster County men, including a teacher at a private Chester County school, have been arrested and charged with distributing child pornography.


They are Hector Colon-Plaza, 44, of 311 E. New St., Apt. 1 in the city, and Joseph Fortunato, 60, of 417 Rabbit Hill Lane in Lancaster Township.

Fortunato was a teacher at Devon Preparatory School in Chester County, Attorney General Kathleen G. Kane  reported. He resigned from that position Monday.

Kane announced the arrests Wednesday as part of ongoing efforts to target the online sharing, downloading and distribution of child pornography.

Agents from the attorney general’s Child Predator Section identified a computer on a peer-to-peer network sharing several media files believed to depict child pornography and the computer’s IP address was later identified as serving Colon-Plaza’s home.

Agents executed a search of Colon-Plaza’s home and seized two laptop computers. A preliminary review of the devices revealed image and video files depicting child pornography. The items will be analyzed further by the attorney general’s Computer Forensics Unit.

Colon-Plaza was taken into custody on April 17 following a five-month investigation.

Colon-Plaza is charged with four counts of possession of child pornography, two counts of distribution of child pornography and one count of criminal use of a communication facility.

He was preliminarily arraigned before District Judge Janice Jimenez and held on $75,000 bail. A preliminary hearing is scheduled for Thursday.

Colon-Plaza is a Megan’s Law offender, so he will face a 25- to 50-year mandatory sentence if found guilty of the charges, Kane said.

Colon-Plaza was convicted of indecent assault in 2011 regarding an incident on Jan. 29, 2010, newspaper records show.

According to police, Colon-Plaza pinned the teenager down in bed, then kissed and touched her until her mother came to her rescue by breaking down a locked door.

Agents from the attorney general’s Child Predator Section investigating online child pornography identified several files of investigative interest being made available for download through a peer-to-peer network, Kane reported. The computer’s IP address was later identified as serving Fortunato’s home.

Agents on April 17 executed a search of the home and seized a desktop computer and external hard drive, both of which contained suspected child pornography, Kane reported.

Fortunato is charged with 20 counts of possession of child pornography, eight counts of distribution of child pornography and one count of criminal use of a communication facility.

He was scheduled to turn himself in to authorities Wednesday.

Both cases will be prosecuted in Lancaster County by Senior Deputy Attorney General Christopher Jones of the attorney general’s Child Predator Section.
